3. Data controller, Data processor and the persons in charge of the processing
3.1. Pursuant to the Legislative Decree dated 30th June 2003, no. 196 (“Data Protection Code”) the Data Controller is:
the company Bit2win S.r.l. having its registered office in Via Aurelia no. 547 - 00165 Rome – VAT no. 10819801001 (hereinafter, "B2W")
3.2. Data Controller has the power and the responsibility to decide terms and purposes of data collection also related to security matters.
3.3. Furthermore, due to both organizational and functional activities and pursuant to the section 29 of Personal Data Protection Code, the Data Controller shall designate the data processors (hereinafter the “Data Processor”) and persons in charge of data (hereinafter the “Person in Charge”) as further described below. 4. Personal Data Collection and purposes.
4.1. Under the scope of the Personal Data Protection Code, personal data are collected and processed for the following purposes and terms.
(a) Contact request – Personal data are voluntarily provided by the User by sending emails and are only processed in order to answer to contact requests and provide information about products/services of the Data controller.
(b) Job application – Personal data (i.e. name, surname, sex, date of birth, place of birth, address, post code, city, email and cv) are collected when the User enters personal data in the section Job Application

The collected Personal Data are strictly processed only for research, recruitment and hiring personnel purposes by the Data Controller in compliance with the rule of law and national collective bargaining agreements, and in respect of the EU principles, transparency, advertising and impartiality. The collected data are processed in order to evaluate the eligibility criteria before hiring for the applied position or other candidates that may be hired in the future.
4.2. In all before-mentioned cases the User is not required to provide personal data disclosing her/his health status, race or ethnic group, beliefs, political convictions, sexual oriental and sensitive information pursuant to the Personal Data Protection Code.
4.2. Going beyond what is provided in previous sections, the Personal Data may be also used for the purposes hereinafter (however specific and separated consent is request to the User);
c) send information for promotional and marketing campaigns such as newsletter, advertising, goods and services offering by the Data Controller, namely individuals or legal entities collaborating with the Data Controller as to marketing and sales activities;
(d) events organization or initiatives for advertising purposes;
(e) elaborate statistics and market research.
4.3 Whether the User authorize advertising communication, the Data Controller ensures the Users to exercise their right not to receive future communication at any time and without having to state their reasoning.
4.4. The provision of the Personal Data is optional. However, the consequence of refusal by the User or imprecise or uncompleted information, is the impossibility of benefiting from those services described at the section 4.1.
5. Processing Methods
5.1. The Personal Data are mainly processed by electronic means and sometime by paper means. The Personal Data will be stored for the time needed for the purposes of collection and within the limits of law.
The User shall be the sole liable for the Personal Data communication related to third parties without having their specific consent and/or the misuse and/or unlawful use of the Personal Data.
5.3. The Data Controller may exercise the right of eliminating the accounts of those registered Users, including specific Personal Data when illegal contents are detected and affecting the image of Data Controller, or in any case of offensive contents and/or promoting illegal or reprehensible activities.
6. Communication of Personal Data
6.1. Without prejudice of the communication in compliance with the applicable law, the Personal Data may be communicated by individuals or legal identities supporting the Data Controller and operating the website and providing specific services.
6.2. By way of example, the Data Controller may communicate the Personal Data to third parties in the categories: (i) subjects operating either technical and organizational activities on behalf of the Data Controller; (ii) subjects in charge of collecting and processing data with the purpose of processing the Job Applications; (iii) subjects providing services for the website operation and IT system and appointed by the Data Controller; (iv) subjects carrying out filing and data entry activities; (v) subjects operating in the framework of assistance and consultancy relationships, inter alia legal and accounting activities; (vi) public authorities and control and supervisory bodies.
6.3. According to the circumstances, the above mentioned subjects operate as in charge of and/or appointed persons for Data Processing and are different from Data Controller
7.2. However, the Data Controller may not guarantee that those implemented security measures will appropriately limit or exclude the risk of unauthorized access or loss of the Personal Data. It is strongly recommended to the Users to provide their computer and internet access with adequate tools to protect Personal Data transmission on the network.
8. Other User rights
1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
2. A data subject shall have the right to be informed
a) of the source of the personal data;
b) of the purposes and methods of the processing;
c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) of the identification data concerning data controller, data processors and the representative designated as per Section 5(2);
e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3. A data subject shall have the right to obtain
a) updating, rectification or, where interested therein, integration of the data;
b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4. A data subject shall have the right to object, in whole or in part,
a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
8.2. The User shall exercise her/his rights within the limits of law by sending an email to the Data Controller to the email: email@example.com
9. Link ad altri siti web
9.1. The Website may include links to third parties’ websites which are not connected with the Website or Data Controller.
9.3. When the links are activated to third parties’ websites, the websites access and browsing are not recommended by the Data Controller, and they do not provide warranties about the contents, services or goods which are provided with the purpose of selling them to the Internet Users.
10.1. Cookies are files containing small texts placed on the User pc when browsing a website. When the User is visiting the website they are retransmitted to the it (fist-party cookies) or to third party website (third-party cookies. Cookies have different purposes such as browsing efficiently the website, preferences and in general to improve browsing User experience.
